Special Education Rights in San Francisco, CA
People are generally unaware that are many laws and regulations that have been put in place to secure the rights of children with special needs. A great example would be the Individuals with Disabilities Education Act (IDEA) which became federal law in 1975. Initially called the Education for All Handicapped Children Act, the purpose of IDEA was to give a free appropriate public education (FAPE) for kids, and to describe the rights of the legal guardians to decide the child’s educational program
Though many protective laws have been put in place, parents and legal guardians found it burdensome to obtain the accommodations, support, and services for their child’s education. Tsadik Law has consulted and represented hundreds of families, and we would be happy to fight to gain the provisions your child is legally entitled to.
Is My Child Eligible For IDEA?
There are some guidelines to see if a child is eligible for IDEA. To qualify to obtain special education services, a child must meet one or more of the legal criteria listed in the categories below.
- Multiple Disabilities
- Deaf-blindness
- Speech or Language Impairment
- Intellectual Disability
- Hearing Impairment
- Traumatic Brain Injury
- Autism
- Visual Impairment Including Blindness
- Emotional disturbance
- Deafness
- Specific Learning Disability (includes Dyslexia, Dyscalculia, Dysgraphia, and Other Learning Differences)
- Orthopedic Impairment
- Established Medical Disability
- Other Health Impairment (includes ADHD)
Though a child may be medically diagnosed to have one of the eligibility criteria, this does not mean the child will be qualified for IDEA. Eligibility Assessment
If you believe that your child requires additional support for their special education needs, and has not been assessed for eligibility, or if the school district has already determined that your child is ineligible, we can assist you with getting a reevaluation.
How Do I Request Special Education Services For My Child?
If your child has been diagnosed with any of the previously listed disorders, or if you believe your child has one of these disabilities, you should begin by having an assessment by the school district. The school district is required to give your child a free evaluation. Submit your request to the district in writing and keep a record of that request. After your child goes through the assessment, you then present a written request to the school for an IEP team meeting. At this meeting, the results of the evaluation will determine what special education services your child is eligible for.
What If The District Claims That My Child Does Not Qualify?
After the assessment and IEP meeting, the District may disagree with your opinion about your child’s need for special education programs. However, there are still several steps you can take. You could pay for an independent educational evaluation (which can potentially be reimbursed by the district after a legal process). You could also contact a special education attorney and file a due process request. The district will re-evaluate your child if you feel the initial assessments were not adequate.
