Special Education Rights in Bakersfield, CA
Many people are not aware of the regulations that were created for special needs children to get an education. The first example could be the Individuals with Disabilities Education ACT (IDEA) which was codified into federal law in 1975. Initially called the Education for All Handicapped Children Act, the purpose of IDEA was to allow a free appropriate public education (FAPE) for kids, and to define the rights of the legal guardians to decide the child’s educational program
Though many protective laws have been put in place, parents and legal guardians found it problematic to obtain the accommodations, support, and services for their child’s education. Tsadik Law is here to guide and represent your family, and advocate for you to receive the full provisions that your child is entitled to by law.

Frequently Asked Questions
How is Eligibility Accessed?
If you conclude that your child requires special accommodations for education, hasn’t been accessed or has been determined ineligible, then you can contact us today at 213-677-0999. We will help you in getting a reevaluation.
How can I ask for Special Education For My Child?
If your child has been diagnosed with any of the conditions that are listed here, or if you think that your child may have one of these conditions, the first thing you should do is get your child evaluated by the school. It is mandatory by law your school district to give your child a free evaluation. Give a request to the school district to have your child evaluated, and keep a copy for yourself as a record. Following the evaluation, you can submit a request in writing to schedule an IEP meeting. After the meeting is had, you will receive the results of the evaluation, and the school will decide on your child’s eligibility.
What if the Bakersfield School District Declares my Child Ineligible?
After you receive an assessment and after the IEP meeting, if the school district decides your child is not eligible for special education services, there are a few courses of action available to you. One option you have is to get an independent appraisal, which can potentially be recompensed by the school district. The other option is to get professional advice from a special education attorney. The attorney can file a due process request with the school district and you will receive another reevaluation.
