Special Education Rights in Bakersfield, CA

Many people are not aware of the regulations that were created for special needs children to get an education. The first example could be the Individuals with Disabilities Education ACT (IDEA) which was codified into federal law in 1975. Initially called the Education for All Handicapped Children Act, the purpose of IDEA was to allow a free appropriate public education (FAPE) for kids, and to define the rights of the legal guardians to decide the child’s educational program

Though many protective laws have been put in place, parents and legal guardians found it problematic to obtain the accommodations, support, and services for their child’s education. Tsadik Law is here to guide and represent your family, and advocate for you to receive the full provisions that your child is entitled to by law.

Here are some common problems a child with special needs may meet at school:

  • Lack of Behavioral Support
  • Difficulty With Writing
  • Challenges With Organization
  • Issues With Navigating the School Campus
  • Difficulty Concentrating and Focusing
  • Suspension and/or Expulsion
  • Speech and Language Deficits
  • Lack of Behavioral Support
  • Social and Emotional Problems
  • Dealing with Bullying
A parent with a disabled child has the right to lodge a complaint against their local school district alleging transgression of the state and federal education laws. The grievance will oftentimes be addressed in mediation, but if it can’t be resolved, an administrative judge will be assigned to oversee a due process hearing. The attorneys at Tsadik Law are reachable, and we will even meet with many clients in person at a nearby location.

Frequently Asked Questions

How is Eligibility Accessed?

If you conclude that your child requires special accommodations for education, hasn’t been accessed or has been determined ineligible, then you can contact us today at 213-677-0999. We will help you in getting a reevaluation.

How can I ask for Special Education For My Child?

If your child has been diagnosed with any of the conditions that are listed here, or if you think that your child may have one of these conditions, the first thing you should do is get your child evaluated by the school. It is mandatory by law your school district to give your child a free evaluation. Give a request to the school district to have your child evaluated, and keep a copy for yourself as a record. Following the evaluation, you can submit a request in writing to schedule an IEP meeting. After the meeting is had, you will receive the results of the evaluation, and the school will decide on your child’s eligibility.

What if the Bakersfield School District Declares my Child Ineligible?

After you receive an assessment and after the IEP meeting, if the school district decides your child is not eligible for special education services, there are a few courses of action available to you. One option you have is to get an independent appraisal, which can potentially be recompensed by the school district. The other option is to get professional advice from a special education attorney. The attorney can file a due process request with the school district and you will receive another reevaluation.

Is My Child Eligible for IDEA?

There are some criteria to see if a child is eligible for IDEA. To qualify to obtain special education services, a child must meet one or more of the legal criteria listed in the categories below.

  • Orthopedic Impairment
  • Autism
  • Emotional disturbance
  • Established Medical Disability
  • Hearing Impairment
  • Multiple Disabilities
  • Other Health Impairment (includes ADHD)
  • Speech or Language Impairment
  • Specific Learning Disability (includes Dyslexia, Dyscalculia, Dysgraphia, and Other Learning Differences)
  • Deaf-blindness
  • Traumatic Brain Injury
  • Visual Impairment Including Blindness
  • Intellectual Disability
  • Deafness
Though a child may be medically diagnosed to have one of the eligibility criteria, this does not mean the child will be qualified for IDEA. It is written in the law that the child’s disability must alter their access to the curriculum, and because of that, requires special education to continue progressing in school. If you are confused about whether your child qualifies for special education services, simply give us a call at 213-677-0999 for a free consultation. Tsadik Law can help you with electing the best course of action to help your child get the education they require.
